Affiliate Program Terms

These terms apply to OpusFunnel's own partner program, run at partners.opusfunnel.com. They are an agreement between you and OpusFunnel, a company organised in the United States ("OpusFunnel", "we"). You accept them when you apply. They do not apply to affiliate programs our customers run for their own businesses; those have their own terms.
Joining
- You apply on the partner page. We approve applications at our discretion and may decline without giving a reason.
- You must be at least 18. You do not need to be an OpusFunnel customer.
- Give accurate details and keep them up to date, including your payout details.
Attribution
- A customer counts for you when they sign up within 90 days of last following your link in the same browser, whether they start free, start a trial or pay straight away, and whether they sign up by email or with Google.
- If they follow another partner's link within those 90 days, the newer link counts (last click).
- If we give you a discount code, a customer who uses it at checkout counts for you, with or without your link.
- Attribution by link relies on a cookie set in the visitor's browser when they follow your link. If they block or clear cookies, or sign up in another browser, the sign-up cannot be credited to you.
- Signing up through your own link, or referring an account you control, earns nothing.
- Our records decide attribution.
Commission
- You earn 50% of each subscription payment a referred customer makes to us, calculated on the amount we receive excluding taxes, for as long as that customer keeps paying and the program runs.
- Commission is not paid on usage charged to a customer's balance, or on amounts refunded or disputed. If a payment is refunded or disputed, its commission is reversed, in part for a partial refund.
- If we offer recruit commissions, the rate and rules are shown on your partner page.
- The earnings calculator on our partners page is an illustration, not a promise. Your results depend on who you refer and whether they stay.
Payouts
- Commission becomes payable 30 days after the payment it came from, to allow for refunds.
- We pay monthly once you have at least $50 payable. Smaller balances carry forward.
- Payouts are in US dollars, by PayPal or by bank transfer. Bank transfers are sent by hand. We pay our own sending fees; fees your PayPal account or bank charges to receive the money are yours.
- If a payout cannot be delivered because your details are wrong, it stays payable until you give us working details.
- We email you when a payout is sent.
Tax
- Before we pay you, we may ask for a tax form: a W-9 if you are a US person, or a W-8BEN or W-8BEN-E if you are not. We may hold payouts until we have a valid form.
- We may report payments to tax authorities and withhold tax where the law requires.
- You are responsible for your own taxes, including any VAT or sales tax on your commission. Commission amounts include any such tax.
- Disclose the relationship. Every time you promote OpusFunnel with your link or code, say clearly that you earn a commission, next to the link and before the reader clicks. For example: "I earn a commission if you sign up through this link" or "#ad". A disclosure hidden in an "about" page or at the end of a long post is not enough. This is required by the FTC's Endorsement Guides in the US and by the advertising rules in the UK and EU.
- Only say what is true about OpusFunnel. Use current prices and features from our website, and do not promise results or earnings.
- Only talk about your own experience as your own.
- We may check how you promote us. Commission earned in breach of this section may be reversed.
Banned methods
You may not:
- bid on "OpusFunnel" or similar terms in search ads, or use our name in a domain, social handle or ad account name;
- send spam, or promote us by text or call without the recipient's consent;
- use coupon, cashback, deal or incentive sites, or pay people to sign up;
- use cookie stuffing, forced clicks, pop-unders, or anything else that sets your cookie without a real click;
- pretend to be OpusFunnel or our staff, or suggest we endorse you;
- promote us next to illegal, hateful or adult content, or anything our Acceptable Use Policy prohibits.
Our brand
While you are a partner, you may use our name and the marketing material on your partner page to promote OpusFunnel, in line with these terms. You may not change our logo or create material that could be mistaken for ours. The permission ends when you leave the program.
Our relationship
You are an independent contractor, not our employee, agent or partner in law. You cannot make promises or contracts on our behalf. Keep confidential anything we share with you that is not public.
Your data
We use your details, payout information and tax forms to run the program and meet tax duties, as explained in the Privacy Policy. Tax forms are kept in private storage and are seen only by the people at OpusFunnel who handle payouts.
Changes and ending
- We may change these terms, the commission rate or the program, or end the program, on 30 days' notice by email. Commission earned before a change takes effect stays payable on the old terms.
- You may leave at any time by telling us.
- We may remove you from the program at any time. If we remove you for fraud, a banned method or a serious breach of these terms, you lose commission that has not yet been paid. Otherwise, commission already earned is paid under the normal rules.
Liability and governing law
To the extent the law allows, we are not liable for indirect losses or lost profits, and our total liability to you under these terms is limited to the commission paid or payable to you in the 12 months before the claim. These terms are governed by the laws of the United States and of the state in which OpusFunnel is organised, and the state and federal courts located in that state have exclusive jurisdiction over any dispute arising from them.
